Maryland Seller Disclosure Requirements

Maryland law establishes specific obligations for residential property sellers, and understanding them before listing can help reduce post-closing liability. Under Md. Code § 10-702 of the Real Property Article, sellers of residential property with up to four units must deliver to the buyer either a Residential Property Disclosure Statement or a Disclaimer Statement before a contract of sale is signed.

The disclosure statement requires sellers to identify known material defects. The disclaimer is an as-is election, but it doesn’t eliminate all disclosure duty. Known latent defects, meaning defects that are hidden and not discoverable through a reasonable inspection, must still be disclosed even when a seller elects the disclaimer path. Failure to disclose known latent defects can expose a seller to rescission of the sale, damages, and in some circumstances, court-awarded attorney fees.

Timing matters under this statute. Delivering the disclosure or disclaimer after the buyer has signed can give the buyer a right to rescind. An inaccurate or incomplete disclosure can create civil exposure well after the sale closes.

Federal law adds a separate layer for homes built before 1978. Sellers of pre-1978 properties must provide a lead-based paint disclosure and give buyers a 10-day opportunity to conduct a lead inspection or risk assessment before the buyer is obligated under the contract. Buyers may waive this inspection opportunity in writing. Maryland’s disclosure requirements are administered by the Maryland Real Estate Commission under Title 10, Subtitle 7 of the Annotated Code of Maryland.
