The purpose of a National Firearms Act “NFA” Firearms Trust is to take title to certain items (machine guns, short barrel rifles/shotguns, suppressors) regulated by the NFA in the name of a trust to allow the possession of the items by the trustees and to avoid certain regulations applicable to the acquisition of NFA items by individuals.
With an NFA Firearms Trust, you avoid the requirement to be fingerprinted, to be photographed, and you avoid the requirement that you obtain approval from local law enforcement. With an NFA Firearms Trust, you need only submit your trust document, two federal forms completed by your licensed dealer, and your check for $200 to the ATF.
In addition, the trust allows multiple people to legally possess the NFA item, as well as an easy way to add and subtract those people from the trust. Remember, only those people authorized by ATF to possess the NFA item can have access to it.
If you are interested in creating an NFA Firearms Trust and you live in Maryland or Virginia, Hartman and Egeli, LLP can help. For a flat fee of $400.00, we will prepare a trust document acceptable to the ATF for the purpose of acquiring an NFA item. We will also prepare a short form of the trust for you to keep with you NFA item and license, as well as blank forms for you to use to add trustees to your trust. And, of course, we will answer any questions you might have about the NFA Firearms Trust and other applicable laws.
