The attorneys at Hartman have been representing individuals and businesses before various agencies of the federal, state, county, and city governments for years. We handle the process for obtaining licenses, zoning issues, development, and disciplinary measures. Here are examples of just a few of the matters we have recently successfully handled.
Liquor licenses: we have obtained liquor licenses for restaurants in Pasadena, Gambrills, Annapolis, and other jurisdictions. These restaurants range from small mom and pop sushi restaurants to national chains. The licenses range from on-premises wine and beer to the full range, including off premises sales. It is important to understand the burden of proof required to present to the Alcoholic Beverage Control Boards, including the need for such an establishment to sell alcohol. Often, there is nothing contentious about such a request; however, in certain areas, the competition can be fierce, and a challenge can be mounted against the applicant. It is vital to prepare, and when necessary, to meet with the community and the possible opposition.
Defense contractor debarment proceedings: Debarment is a procedure where a government contractor is prohibited from obtaining new government contracts. The government need only propose that the contractor be debarred for the contractor to be automatically prohibited from obtaining new contract, i.e. they are guilty before proven innocent. The firm represented a defense contractor facing debarment proceedings and through the appeal process we were able to have the proposed debarment withdrawn and keep the company in business.
Zoning: We have represented clients with divergent interests in many different types of cases over the years. We have assisted with obtaining use, conditional use, special exception permits, and variances. We have assisted in efforts to block inappropriate and destructive re-zoning or spot-zoning. We have assisted clients with large parcels seeking to sub-divide or alter the use of their property.
Banks: We have represented lending institutions for nearly 50 years. Included therein are dealings with the FDIC, DLLR, Attorney General, and other consumer protection agencies. Being familiar with the law applicable to the complaint, as well as the procedures followed by banks and their counsel in debt collection and foreclosure gives us insight valuable to resolution of these matters.
Vessels: Maritime matters are probably the area of law that this firm has handled for the longest period, dating back to the 1930’s. This includes working with marinas, boat manufacturers, yacht clubs, bank loans secured by boats, boatowners, captains, seamen, passenger vessels, tour boats, water taxis, charter vessels, and others. We have had to deal with the Department of Natural Resources, the U. S. Coast Guard, U.S. Marshal’s office, and many other agencies. Our experience is substantial and valuable.
Real property: With ownership of property comes government intrusion and taxation. Certain agencies will try to take, literally or figuratively, portions of your property from time to time, through regulation or outright eminent domain. Taxation, of course, is another means of intruding on your ownership. We are familiar with all such actions against your property, including over assessment for real estate tax purposes, taking by condemnation, limiting the use or structures.
If you are in need of legal assistance and representation with government agencies, because of your business or your personal matters, Hartman can help.
